How Does an Executor Know Where to Find The Will After Someone Passes?
In Singapore, there is no central storage area where Wills are stored. However, there is a Wills Registry, where information regarding the Will may be deposited. Such information include where the Will is held and information regarding the testator. This is not compulsory. Whether or not Will information is deposited in the Wills Registry does not affect the validity of the Will. It must be noted that the Wills Registry does not keep a copy of the actual Will.
Most of the time, the executor will know where the Will is kept so it may be wise to approach the executor. However, there have been cases where the lawyers are entrusted with the will. In these cases, the executor usually has the lawyer’s name and address.
Wills are made to ensure that one’s wishes are honored upon death. Without a Will, one’s assets will be distributed according to the rules of intestacy as laid down in the Intestate Succession Act. After making a will, in order to enforce it, it is of paramount importance that one’s loved ones are able to locate the Will. It is thus vital to take steps to ensure that one’s Will is appropriately stored.
