A recent article by CNA explores the unconventional choice of divorced couples continuing to live together in Singapore. While uncommon, financial considerations and the well-being of children often drive such arrangements. The article highlights different cases where former spouses cohabit post-divorce, emphasizing the need for clear agreements on responsibilities and boundaries.

Our head lawyer, Gloria James, shared key insights into this growing trend, stating:

This is not a common practice in Singapore, but I have seen the rise in numbers.

She emphasized the importance of formal agreements:

Parental responsibilities can be outlined clearly, together with their maintenance obligations.

To prevent unnecessary complications, she advised couples to set boundaries, such as delaying the introduction of new partners while cohabiting:

The last thing you need is forcing the children to accept this new change.

Ultimately, she noted that such arrangements are usually temporary:

As children grow older and become more aware of their family situations, such arrangements are not feasible.

ore’s new Maintenance Enforcement Process (MEP), which commenced on January 16, 2025. This initiative aims to enhance the enforcement of maintenance orders, ensuring that recipients receive the financial support they are entitled to.

The MEP introduces a structured approach to deter non-payment of maintenance and facilitate sustainable outcomes. A key feature is the establishment of the Maintenance Enforcement Division (MED) within the Ministry of Law. This division is staffed by Maintenance Enforcement Officers (MEOs) who are empowered to conduct conciliations, actively seek information, and recommend solutions to parties involved. MEOs can also obtain necessary information from banks and public agencies, ensuring that enforcement applications are resolved based on accurate financial data.

During Phase 1, the MEP applies to individuals who have previously filed one or more court applications to enforce maintenance payments. Applicants can file their enforcement applications with the Family Justice Courts, and eligible cases will be referred to the MED. Respondents undergoing the MEP are subject to a fee of $180 for the MEO’s services, with fee structures subject to review in subsequent phases.

Ms. Gloria James-Civetta, head lawyer at Gloria James-Civetta & Co., emphasises the significance of this development: “The introduction of the MEP marks a pivotal advancement in Singapore’s family justice system. By streamlining enforcement procedures and empowering officers with the necessary tools, the process ensures that maintenance obligations are met promptly and fairly. This reform not only upholds the rights of maintenance recipients but also reinforces the accountability of payers.

With over 28 years of experience in family law, Ms. James-Civetta and her team are well-equipped to navigate clients through these changes. The firm remains committed to providing personalised legal services, ensuring that clients understand their rights and options under the new MEP framework.
